In this present reality, there are more considerations to be made regarding public health and safety. More businesses now have Face Covering Required, Temperature Check, and COVID-19 Self-Assessment Signs outside their establishment in accordance with local and state regulations, or just to do their part in stopping the spread of germs. By posting these signs and notices, businesses can make their expectations clear and help protect themselves from potential litigation. However, Georgia has gone one step further under the passage of Senate Bill 359 (SB359), or the Georgia COVID-19 Pandemic Business Safety Act. This new bill helps protect businesses from COVID-19 claims by effectively halting any COVID-19 claims based on ordinary negligence. The facts of any successful COVID-19 claim must show gross, willful, and wanton misconduct, reckless infliction of harm, or intentional infliction of harm. 

The new law asks businesses to post a sign at building entrances with at least one-inch Arial font placed apart from other text, stating the following: 

“Warning: Under Georgia law, there is no liability for an injury or death of an individual entering these premises if such injury or death results from the inherent risks of contracting COVID-19. You are assuming this risk by entering these premises.”
